*Last Updated: May 16, 2025

Welcome to Swifty's Locks and Keys ("we," "us," or "our"). These Terms of Service ("Terms") govern your access to and use of our website, www.swiftyslocksandkeys.com (the "Website"), and any automotive locksmith services we provide, including car lockout assistance, key cutting, transponder programming, and ignition repair (collectively, the "Services"). By accessing our Website or using our Services, you agree to be bound by these Terms. If you do not agree, please do not use our Website or Services.

1. Eligibility

You must be at least 19, the age of majority in Nova Scotia, to use our Services. By using our Services, you represent that you meet this requirement and have the legal capacity to enter into these Terms.

2. Use of Services

Permitted Use: You may use our Website and Services only for lawful purposes, such as requesting automotive locksmith services or browsing information about our offerings.

Prohibited Conduct:

You agree not to:

Use the Website or Services in any way that violates federal, provincial, or local laws, including the Criminal Code of Canada or Nova Scotia’s Consumer Protection Act.

Attempt to interfere with, hack, or disrupt our Website or systems.

Provide false information when requesting Services (e.g., vehicle ownership details).

Use our Services to harm or harass others.

3. Service Requests

Booking and Payment: You may request Services through our Website, by phone, or by email. We will provide an estimated cost before performing Services, but final costs may vary based on the complexity of the job (e.g., specialized transponder programming). Payment is due upon completion of Services unless otherwise agreed. We accept cash, credit cards, and debit cards.

Verification: For automotive Services, you must provide proof of vehicle ownership (e.g., registration or insurance documents) before we perform Services like key cutting or lockout assistance.

Cancellations: If you cancel a Service request after a technician has been dispatched, you may be charged a cancellation fee to cover travel costs.

4. Intellectual Property

All content on the Website, including text, logos, images, and service descriptions, is owned by Swifty's Locks and Keys or our licensors and is protected by Canadian copyright and trademark laws. You may not copy, modify, or distribute any content without our prior written consent, except for personal, non-commercial use (e.g., printing a service quote).

5. User Content

If you submit content to our Website (e.g., reviews, testimonials, or inquiries), you grant us a non-exclusive, worldwide, royalty-free license to use, display, and reproduce that content for business purposes, such as promoting our Services. You represent that your content is accurate, lawful, and does not infringe on third-party rights.

6. Privacy

Your use of our Services is subject to our Privacy Policy, which complies with Canada’s Personal Information Protection and Electronic Documents Act (PIPEDA). The Privacy Policy explains how we collect, use, and protect your personal information, such as your name, contact details, and vehicle information. By using our Services, you consent to our data practices.

7. Third-Party Links

Our Website may include links to third-party websites, such as payment processors or automotive service partners. We are not responsible for the content, privacy practices, or availability of these third-party sites. Accessing them is at your own risk.

8. Warranties and Guarantees

Service Guarantees: We strive to provide high-quality Services. Specific Services, such as key cutting or lock repairs, may come with limited warranties, which will be communicated at the time of service. For example, we may guarantee key functionality for 30 days, provided the key is not damaged by misuse.

No Vehicle Damage: Our technicians use industry-standard tools to avoid damaging your vehicle during Services like lockout assistance or ignition repair. However, we are not liable for pre-existing damage or issues arising from vehicle condition (e.g., faulty wiring).

9. Limitation of Liability

As-Is Basis: Our Website and Services are provided "as is" without warranties, express or implied, including warranties of merchantability or fitness for a particular purpose.

Liability Cap: To the fullest extent permitted by Canadian law, Swifty's Locks and Keys will not be liable for indirect, incidental, or consequential damages (e.g., lost profits or towing costs) arising from your use of the Website or Services. Our total liability to you will not exceed the amount you paid for the specific Service.

Emergency Services: While we aim to respond promptly (typically within 30 minutes in Halifax Regional Municipality), we are not liable for delays due to factors beyond our control, such as traffic or weather.

10. Indemnification

You agree to indemnify and hold Swifty's Locks and Keys, its employees, and affiliates harmless from any claims, losses, or damages arising from your use of the Services, violation of these Terms, or misrepresentation of vehicle ownership.
